Legal protections against governmental surveillance, however, may in other cases enhance social welfare by encouraging productive transactions, diminishing the costs of non-legal privacy barriers, and limiting suboptimal policing practices, including discriminatory profiling and the enforcement of inefficient criminal prohibitions.
