  • Failure to avoid collision is an offence, so both skippers could be found to be at fault. the whaler which was the give way vessel took no action to avoid the collision, didn???t reduce speed or change course in fact seemed to steer a course that contributed to the collision. both skippers could be charged with failure to keep a proper lookout.
