  • There is no such legally correct answer, because the decision to accept an amicus brief is and has always been in the sole discretion of the court and there are absolutely no limits to that discretion, outside (perhaps) of my rather absurd hypothetical about a judge who decides to accept amicus briefs based on race or other protected class.
