| http://www.w3.org/ns/prov#value | - If the Supreme Court takes both cases, it would have to resolve a lot of issues regarding 'animus', and I can not see Justice Kennedy finding that there was 'animus'; he is not someone who generally likes to accuse others, especially government officials, of intentional wrongdoing, hatred or bad faith.
