| http://www.w3.org/ns/prov#value | - (h) (1) Except in the case of an emergency, as provided in subdivision (4) of this subsection, upon receipt of a request for a hearing to appeal any proposed transfer or discharge, the Commissioner of Social Services or [his] the commissioner's designee shall hold a hearing to determine whether the transfer or discharge is being effected in accordance with this section.
