Practice concerning the applicability of international humanitarian law, including when it comes to dealing with admittedly sensitive and sometimes complex issues such as whether a situation qualifies as an armed conflict and, if so, whether it is domestic or international in character, has unfortunately been somewhat inconsistent and, on occasion, frankly questionable.
